Terms of Service
These Terms govern your use of the Prospector Maps website and application (the "Service"), operated by The Social Grove ("we", "us"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
Prospector Maps is an informational mapping and analysis tool for gold prospectors. It presents geological, geophysical, land-access, and modelled prospectivity data to help you research ground. It is a decision-support tool, not professional geological, legal, or financial advice.
2. Accounts
You must be at least 18 and provide accurate information. You are responsible for activity under your account and for keeping your credentials secure. One person or entity per account unless we agree otherwise.
3. Free trial, subscriptions & billing
- Free trial. New accounts receive a free trial (currently 3 days). A payment method is taken at the start of the trial; nothing is charged until it ends, and cancelling before then costs nothing. We may change or end trials at any time.
- Subscriptions. After the trial, continued access requires a paid subscription — currently US$7.99/month or US$59/year. Prices are shown at checkout and may change on renewal with notice.
- Auto-renewal. Subscriptions renew automatically at the end of each period until cancelled. You authorise us and our processor (Stripe) to charge your payment method.
- Cancellation. You may cancel anytime from the in-app billing portal; access continues until the end of the paid period.
- Refunds. Except where required by law, payments are non-refundable. Your statutory rights as a consumer are not affected.
- Taxes. Prices may exclude applicable taxes, which may be added at checkout.
4. Acceptable use
You agree not to: misuse or disrupt the Service; scrape, resell, or bulk-extract data except as permitted; reverse-engineer or circumvent access controls; upload unlawful content; or use the Service to break the law. We may suspend or terminate accounts that violate these Terms.
5. Your content
You retain ownership of the content you create (waypoints, finds, notes, images). You grant us a limited licence to host and process it to operate the Service. You are responsible for your content and must have the rights to it.
6. Important limitations — read carefully
- No guarantee of gold. Prospectivity scores rank ground by evidence; they are not a probability or promise of payable gold. Nothing in the Service is a guarantee that gold is present or recoverable at any location.
- Land access is guidance, not legal truth. Claim, ownership, and access information is drawn from third-party public data that may be incomplete, out of date, or superseded. It does not constitute legal advice or authorisation. You are solely responsible for verifying current claim status, land ownership, permits, and the law before entering or working any ground.
- Field safety & assumption of risk. Prospecting and travel in remote terrain are inherently dangerous. You assume all risks of your activities. We are not responsible for injury, loss, or damage arising from your use of the Service or reliance on its data.
- Third-party data. We do not warrant the accuracy, completeness, or currency of third-party datasets.
7. Disclaimer of warranties
The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.
8. Limitation of liability
To the fullest extent permitted by law, The Social Grove will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the 12 months before the event giving rise to the claim. Nothing limits liability that cannot be limited by law (e.g. death or personal injury caused by negligence).
9. Indemnity
You agree to indemnify The Social Grove against claims arising from your misuse of the Service, your content, or your breach of these Terms or the law.
10. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate access for breach of these Terms or where required by law. Certain provisions (e.g. limitations, disclaimers, indemnity) survive termination.
11. Changes to the Service and Terms
We may modify the Service or these Terms. Material changes to the Terms will be posted here with a revised date; continued use after changes take effect constitutes acceptance.
12. Governing law
These Terms are governed by the laws of the United Kingdom, and disputes are subject to its courts, except where mandatory local consumer law provides otherwise.
